Terms of Use

These Terms of Use govern your access to and use of Xulah, including the website at xulah.com, Xulah accounts, subscriptions, content-generation tools, content calendars and related services.

By creating an account, purchasing a subscription or using Xulah, you agree to these Terms.

In these Terms, “Xulah”, “we”, “us” and “our” refer to Xulah.

2. What Xulah provides

Xulah is an AI-assisted content intelligence platform.

Depending on your plan and the features available to you, Xulah may help you generate and improve social media content, develop hooks, captions and scripts, create content strategies and calendars, save generated content, create alternative versions and find suggested media.

Available features, limits and prices are shown on the Xulah website. Xulah assists with content creation, but it does not replace your judgement or professional advice.

3. Who may use Xulah

You must be at least 18 years old to create an account or purchase a subscription.

You may use Xulah for yourself, your business, as part of your work or on behalf of an organisation that has authorised you.

If you use Xulah for an organisation, you confirm that you have authority to accept these Terms on its behalf.

4. Your account

You must provide accurate information when creating and using your account.

You are responsible for keeping your password and email account secure, protecting verification codes, keeping your details up to date and notifying us promptly if you suspect unauthorised access.

You must not sell, transfer or provide your account to another person without our permission.

5. Device security

Xulah may limit an account to one active device at a time. When you sign in from another device, you may be required to complete a device-transfer process using a verification code sent to your registered email address.

You must not attempt to bypass Xulah’s device or account-security controls.

6. Free trials

Xulah may offer a free trial to eligible new users. Trial length, features, usage limits and payment requirements are shown before the trial begins.

Depending on your region, a trial may end automatically without payment or may become a paid subscription unless cancelled before the trial ends.

Unless we clearly state otherwise, a person is entitled to only one Xulah trial.

We may refuse or end a trial where we reasonably believe there has been misuse, fraud or an attempt to obtain repeated trial access.

7. Subscriptions and payments

Paid Xulah plans are normally billed monthly unless a different billing period is shown before purchase.

Before you subscribe, we will show the selected plan, price, billing period, main features and limits, whether a trial applies, when payment begins and whether the subscription renews automatically.

Payments may be processed through providers such as Stripe or Paystack.

You authorise the relevant payment provider to charge the payment method connected to your subscription.

8. Automatic renewal

Where automatic renewal applies, your subscription will renew at the end of each billing period until cancelled.

Cancelling stops future renewals. Unless required otherwise by law, you will normally retain access until the end of the period already paid for.

9. Plan changes and service limits

Each plan may have different generation limits, content-calendar allowances, tools, features and access restrictions.

Current plan details are shown on the pricing or subscription page.

Some payment providers may not support immediate plan changes. Where this applies, you may need to cancel the existing subscription and select a different plan after the current billing period ends.

We may change plans, features, limits or prices from time to time. A price change will not normally affect a billing period you have already paid for.

10. Cancellation rights

You may cancel an automatically renewing subscription at any time to prevent the next renewal.

Subscription cancellation and account closure are separate actions.

UK consumer cancellation rights

If you are acting as a UK consumer, you may have a legal right to cancel an online service contract within 14 days of entering into it.

Because Xulah provides access immediately, we may ask you to expressly request that the service begins during the cancellation period.

Nothing in these Terms removes any cancellation or consumer right that the law gives you.

11. Refunds

Subscription payments are generally non-refundable once a paid billing period has begun, except where the law requires a refund, you validly exercise a statutory cancellation right, you were charged incorrectly, a duplicate payment was taken or we agree that a refund is appropriate.

This does not affect your legal rights where the service is not provided with reasonable care and skill, is not as described or otherwise fails to meet applicable consumer-law requirements.

12. Your prompts, content and uploads

You retain any rights you already hold in the prompts, text, business information, images and other material you submit to Xulah.

You give Xulah permission to process, store, reproduce and transmit that material only as reasonably necessary to provide the service, generate requested content, save your history, operate your account, maintain security and meet legal obligations.

You confirm that you have the right to submit and use all material you provide.

13. AI-generated output

Subject to applicable law and third-party rights, you may use content generated for you by Xulah.

AI-generated content may contain errors, may not be unique, may resemble existing material and may not always be accurate or suitable for your purpose.

You must review, edit and approve content before publishing or relying on it.

You remain responsible for ensuring that published content is accurate, lawful and appropriate.

14. Professional and business decisions

Xulah provides content intelligence and writing assistance. It does not provide legal, financial, tax, medical or other regulated professional advice.

Xulah does not guarantee sales, engagement, growth or business performance.

15. Suggested media and third-party services

Xulah may suggest media from third-party providers such as Unsplash or Pexels. Media remains subject to the provider’s licence and terms.

Xulah may also link to payment portals, social platforms and other third-party services. Those services operate under their own terms and privacy policies.

16. Acceptable use

You must not use Xulah to:

  • break the law or deceive, defraud or impersonate someone;
  • harass, threaten or exploit another person;
  • infringe intellectual-property or privacy rights;
  • distribute malware or harmful code;
  • gain unauthorised access to an account or system;
  • bypass payment, usage, device or security controls;
  • resell account access without permission;
  • overload, scrape or disrupt the service; or
  • use Xulah in a way that creates a serious legal or security risk.

17. Xulah’s intellectual property

Xulah and its licensors own the platform, including its software, design, branding, interface, templates, prompt systems, documentation and underlying technology.

Your subscription gives you a limited, non-exclusive and non-transferable right to use Xulah while your account remains authorised.

18. Availability and changes

We aim to keep Xulah available and reliable, but we do not guarantee uninterrupted or error-free access.

We may update, improve, replace or remove features.

Where a change would materially reduce a paid service, we will take reasonable steps to provide notice or an appropriate remedy where required by law.

19. Suspension and account closure

We may temporarily restrict or suspend an account because of unpaid charges, suspected fraud, unauthorised access, serious or repeated breach of these Terms, unlawful use, a security risk or a legal requirement.

You may request account closure by emailing info@xulah.com.

Before closing your account, cancel any active subscription and download any content you wish to keep.

20. Our responsibility to you

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or failure to use reasonable care and skill.

We are not responsible for decisions made without properly reviewing AI-generated output, content you publish, misuse of your account caused by failure to protect it or third-party services outside our control.

If you use Xulah for business purposes, our total liability arising from the service will normally be limited to the amount you paid to Xulah during the 12 months before the event giving rise to the claim, except where liability cannot legally be limited.

21. Privacy

Our use of personal information is explained in the Xulah Privacy Policy.

22. Changes to these Terms

We may update these Terms when Xulah changes, new features are introduced, payment arrangements change or legal requirements change.

The latest version will be published on xulah.com with its effective date.

23. Governing law

These Terms are governed by applicable law in the United Kingdom.

If you are a consumer, you may also benefit from mandatory rights under the law of the place where you normally live.

24. General terms

If part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

These Terms, together with the Privacy Policy and information shown during subscription checkout, form the agreement between you and Xulah.
